Welcome to Movement Digital Marketing (“Movement,” “we,” “our,” or “us”). By accessing our website, engaging with our content, or purchasing our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using our services.

1. Services Provided

Movement provides digital marketing services, including but not limited to:

• Social media content creation and management

• Paid advertising campaigns

• Video production and editing

• Marketing consulting and strategy

All services are provided in accordance with the scope, timeline, and pricing outlined in your service agreement, proposal, or invoice.

2. Client Responsibilities

To ensure effective results, you agree to:

• Provide accurate business information, branding assets, and timely feedback.

• Comply with all applicable laws, regulations, and advertising policies (including FTC disclosure requirements).

• Maintain any necessary accounts (e.g., social media, payment gateways) and grant us required access.

• Refrain from uploading unlawful, harmful, or infringing content.

3. Payments & Fees

• All invoices are due according to the terms stated on the invoice or service agreement.

• Late payments may incur interest charges and/or suspension of services.

• All payments are non-refundable unless otherwise stated in writing.

4. Intellectual Property

• Client Content: You retain ownership of all logos, trademarks, and materials you provide.

• Deliverables: Upon full payment, Movement grants you rights to use the final creative deliverables (e.g., videos, graphics) for your business purposes.

• Pre-existing Materials: Movement retains all rights to processes, templates, software, or tools developed prior to or outside of your project.

5. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement, unless disclosure is required by law.

6. Results Disclaimer

We strive to provide strategies that maximize engagement and growth. However, we do not guarantee specific results such as revenue increases, follower counts, or engagement levels. Marketing outcomes depend on multiple factors outside of our control.

7. Limitation of Liability

To the maximum extent permitted by law:

• Movement shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.

• Our total liability is limited to the amount paid by you for services within the three (3) months preceding the claim.

8. Termination

Either party may terminate services with written notice. If you terminate early, you remain responsible for payment of all services rendered and expenses incurred up to the termination date.

9. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles. Any disputes shall be resolved in courts located within Flathead County, Montana.

10. Changes to Terms

We may update these Terms at any time. Updates will be posted with a new “Last Updated” date. Your continued use of our services indicates acceptance of the revised Terms.
